The President of India may from time to time fix the number of Election Commissioners of the Election Commission of India, on the basis of :
1) Advice by the Chief Election Commissioner (CEC)
2) Advice by the Prime Minister’s Office (PMO)
3) Recommendation of the Ministry of Law & Justice, Govt. of India
4) The law made in that respect by the Parliament of India
