A national emergency can be declared on the basis of external aggression or armed rebellion in the whole of India or a part of its territory under Article 352. Such an emergency was declared in India in 1962 (China war), 1971 (Pakistan war), and 1975 (declared by Indira Gandhi).
The provision is taken from Germany.
The 44th Constitutional Amendment Act replaced the phrase ‘internal disturbance’ with the ‘armed rebellion’ to avoid its misuse by the government in power.
The term Internal Disturbance might also include political agitations and public strike in the country. Hence, it was removed.
